Terms of Service

These Terms of Service ("Terms") govern your use of the Articulate mobile application (the "App") and related services provided by Articulate AI LLC ("Articulate," "we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, don't use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Account Registration

Some features require an account. You agree to provide accurate information and to keep your login credentials secure. You're responsible for all activity under your account. Let us know right away if you think someone else has accessed it.

3. Use of the App

Articulate grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Copy, modify, distribute, or create derivative works of the App or its content
• Interfere with or disrupt the App's infrastructure or other users' experience
• Use automated means (bots, scrapers, etc.) to access the App
• Impersonate any person or entity, or misrepresent your affiliation
• Upload or transmit any harmful, abusive, or objectionable content

4. Audio Recordings & Your Content

You can submit audio recordings for speech analysis through the App. You keep ownership of your recordings and anything else you submit ("User Content"). By submitting User Content, you give Articulate a limited, non-exclusive license to process, analyze, and store it for the purpose of providing and improving our speech coaching services.

You confirm that you have the rights to submit your User Content and that it doesn't infringe on anyone else's rights.

5. AI-Powered Analysis

Articulate uses AI to analyze your speech and give you feedback. The analysis is for informational and educational purposes only. It is not professional advice, whether medical, therapeutic, linguistic, or otherwise. Results will vary, and they're not a substitute for working with a professional.

6. Subscriptions & Payments

Certain features of the App may require a paid subscription. If you purchase a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable rate
• You can manage and cancel subscriptions in your device's Account Settings
• Any unused portion of a free trial period will be forfeited upon purchasing a subscription

All prices are subject to change. We will notify you of price changes in advance where required by applicable law.

7. Intellectual Property

The App, including its design, code, algorithms, models, branding, logos, and content (excluding User Content), belongs to Articulate AI LLC. These Terms don't give you any rights to our intellectual property beyond the limited license in Section 3.

8. Third-Party Services

The App may link to or integrate with third-party services. We don't control those services and aren't responsible for their content, privacy practices, or availability. Their own terms and policies apply.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTICULATE AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Articulate AI LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

12. Termination

We can suspend or terminate your access at any time, with or without cause or notice. You can stop using the App whenever you want. When your access ends, your license is immediately revoked. Sections on ownership, disclaimers, indemnification, and liability limits survive termination.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We can update these Terms at any time. If we make meaningful changes, we'll let you know through the App or by email. Using the App after changes take effect means you accept the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and User Privacy Choices, constitute the entire agreement between you and Articulate regarding the App and supersede all prior agreements.
